El Presente trabajo investigativo expone un estudio de la figura del Divorcio en Colombia, se menciona grosso modo nociones anteriores al divorcio como es el matrimonio en sí mismo, dentro de los acápites que conforman la investigación se abordaron las nociones del divorcio, sus antecedentes y evolución. Se analizará sobre las causales de divorcio y cuáles de ellas dan pie a que su configuración se traduzca un hecho dañino en los que se deba reparar al cónyuge inocente, la interpretación de las causales del divorcio permitirá a su tiempo comprender cuales son los efectos por el incumplimiento a las consignas del matrimonio por los cónyuges, una vez estudiados se establecen los elementos constitutivos para indemnización de perjuicios en caso de que estos concurran. La metodología a utilizar en el presente trabajo atenderá la modalidad Cualitativa, de diseño interpretativo, Analizaremos la figura del divorcio y las garantías que esta consagra para los cónyuges en su proceso, se inferirá sobre las causales que lo permiten y aterrizaremos especificando cuales son los elementos constitutivos de una indemnización por perjuicios morales al cónyuge inocente en el caso a que este tuviese derecho; lo haremos por medio de la investigación de documentos, doctrina y jurisprudencia, que permite establecer alcances en cuanto a nociones y conceptos ahora, toda vez que se trata de determinar cuáles son las garantías de las partes en este proceso, será indispensable la constitución política de 1991. |

The present investigative work exposes a study of the figure of Divorce in Colombia, notions prior to divorce such as marriage itself are mentioned grosso modo, within the chapters that make up the research the notions of divorce, its background and evolution were addressed. It will be analyzed on the causes of divorce and which of them give rise to its configuration to be translated into a harmful fact in which the innocent spouse must be compensated, the interpretation of the causes of divorce will allow in time to understand which are the effects for the breach of the marriage by the spouses, once studied the constitutive elements for compensation of damages are established in case these concur or / or are configured. The development of the work will be done under the modality of a qualitative methodology and interpretative design, urging to the analysis of the figure of the divorce search that will be carried out in documents, doctrine and national jurisprudence allowing us to establish the scope of the subject to investigate, it is indispensable then to establish if the spouses have the right to a compensation for moral damages in a process of contentious divorce to infer in the study of the political constitution of 1991, the national jurisprudence of the high courts as the Sentence SU 080 of 2020 and other concordant laws. |
